General Terms and Conditions (GTC) from the SWEED AG

The offer on this website is aimed exclusively at customers with Swiss domicile who are over 18 years old.

1. Scope

For the use of this website and the business relationships between the Sweed AG Baarerstrasse 27, CH-6300 Zug and its customers are subject to the following General Terms and Conditions (GTC) in the currently available and valid version when the website is accessed or when goods are ordered.

A customer is any natural or legal person who is SWEED maintains business relationships. The terms and conditions, the delivery and payment conditions as well as the data protection regulations can be adjusted from time to time. SWEED asks you to read these provisions carefully each time you visit the website and each time you order goods.

3. Offer and prices

Our offers are non-binding in terms of price, availability and delivery times. We only ship/sell our products to people over the age of 18 and within Switzerland. SWEED accepts no liability for non-compliance with our terms and conditions. Payments made which have violated our terms and conditions will not be refunded.
The prices of SWEED Unless otherwise noted, include the statutory value added tax and any tobacco taxes. The prices are net in Swiss francs (CHF). Unless otherwise provided, any shipping costs will be charged additionally and must be paid by the customer. Shipping costs are shown separately in the ordering process. The prices for dealer customers are exclusive of VAT, these are displayed in the shopping cart.

4. Conclusion of contract

The offers on this website represent a non-binding invitation to the customer SWEED to order products and/or services. With the order via this website including the acceptance of these terms and conditions, the customer submits a legally binding offer to conclude a contract.

5. Payment options and retention of title

TWINT is our preferred payment option because we have to pay the lowest bank fees. The payment options specified in the ordering process are available to the customer. SWEED reserves the right to exclude customers from individual payment options without giving reasons or to insist on prepayment. 

We offer free purchase on account to our valued customers. For new customers, an identity and creditworthiness check is carried out in advance and the maximum order value for a first order is CHF 100. The total amount is due within 14 days. First orders must first be paid in full in order to receive further orders by invoice.

After the payment period has expired, we will send you a payment reminder, followed by reminders. Reminder fees amount to 15 CHF and 5% interest on arrears. Delinquent payers will be forwarded to our debt collection agency, which will initiate legal steps up to enforcement. 

SWEED can charge default interest of 5% and a reminder fee of CHF 15 per reminder if the customer is in default of payment. The products delivered to the customer remain the property of until full payment has been made SWEED. We will send you a payment reminder after 7 days of late payment. The first reminder follows 7 days later. A further 7 days later you will receive the 2nd reminder with a reminder fee of CHF 15 and default interest of 5%. Invoices that are not paid after the 2nd reminder are forwarded to our debt collection office, which initiates a legally valid operation. 

Postfinance Card or e-finance

With PostFinance you can pay conveniently, securely and free of charge via the Internet. The amount will be debited directly to your postal account on the day the order is placed.

6. Delivery, inspection obligation, notification of defects and return

Deliveries are sent by A Mail Priority or courier service to the address specified by the customer in the order. With the shipment, benefit and risk are transferred to the customer, insofar as this is legally permissible. SWEED is not obliged to prove the shipment. If the goods are lost during shipping, the provider cannot be held liable.

If the delivery cannot be delivered or if the customer does not pick it up, the additional shipping costs and a processing fee of SFr. 20 to be borne by the customer. A new dispatch takes place only after receipt of payment. SWEED can terminate the contract after notification of a complaint by email to the customer and setting a reasonable period of time.

Your order will be packed on the same working day and sent via A Mail if you order before 15.00 p.m. Due to the increased order volume, retail customers are only served on the same working day if the order arrives before 15.00 p.m. We do everything possible to process dealer orders afterwards so that you receive your goods as quickly as possible.

In particular, it is neither assured nor guaranteed that the use of the website will not infringe the rights of third parties that are not owned by SWEED are.

8. Liability

SWEED is not liable in particular for indirect damage and consequential damage, lost profits or other personal injury, property damage and pure financial loss of the customer. A further mandatory statutory liability remains reserved, for example for gross negligence or illegal intent.

SWEED uses hyperlinks only for the simplified access of the customer to other web offers. SWEED cannot know the content of these websites in detail, nor assume liability or any other responsibility for the content of these websites.

Privacy Policy

SWEED may process and use the data recorded during the conclusion of the contract to fulfill the obligations arising from the purchase contract and use it for marketing purposes. 10. Other provisions

SWEED expressly reserves the right to change these GTC at any time and to put them into effect without notice.

In the event of a dispute, only substantive Swiss law applies, with the exclusion of conflict-of-law norms. The UN sales law (CISG, Vienna Sales Law) is explicitly excluded.

The place of jurisdiction is Zug, unless the law provides for mandatory places of jurisdiction.
